Terms of Service

These Terms govern your use of the Kethosbase website and platform (the "Service"), provided by Kerythos AI LLC ("Kerythos", "we", "us") — Kethosbase is a Kerythos product. By using the Service you agree to these Terms. If you use the Service for an organization, you accept on its behalf.

1. The Service

Kethosbase provides a PostgreSQL database with an instant REST API, authentication, file storage, and realtime channels per project. We are actively developing the Service and may add, change, or remove features.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. Tell us promptly of any unauthorized use. You must be able to form a binding contract to use the Service.

3. Acceptable use

You agree not to: break the law; infringe others' rights; send spam, malware, or illegal content; probe, overload, or disrupt the Service or its infrastructure; circumvent quotas or security; or use the Service to build a competing offering by scraping it. We may enforce reasonable rate and resource limits.

4. Your content

You own the data you put into your projects ("Customer Data"). You grant us the limited rights needed to host, process, and back it up to operate the Service. You are responsible for your Customer Data, for having the right to process it, and for any consent your own end-users require. Our handling of personal data is described in the Privacy Policy.

5. Plans, fees, and billing

Free and paid plans may be offered. Paid plans are billed through Stripe on the terms shown at purchase; fees are non-refundable except where required by law. We may change plans or pricing on prospective notice. Taxes are your responsibility unless stated otherwise.

6. Availability and "as is"

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. Keep your own backups of critical data.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amounts you paid us for the Service in the three months before the event giving rise to the claim.

8. Indemnification

You will defend and indemnify us against claims arising from your Customer Data or your use of the Service in breach of these Terms or the law.

9. Suspension and termination

You may stop using the Service and delete your projects at any time. We may suspend or terminate access for breach of these Terms, risk to the Service or others, or as required by law. On termination, your right to use the Service ends; we may delete Customer Data after a reasonable period.

10. Changes to these Terms

We may update these Terms; we will revise the date above and, for material changes, give notice. Continued use after an update means you accept it.

11. Governing law

These Terms are governed by the laws of the State of California, United States, and disputes are subject to the state and federal courts located in Los Angeles County, California.
